These terms govern your use of truebuy.ai and everything on it. They are written to be read, not to be skipped. If you do not accept them, do not use the service. By creating an account, uploading a document or making a payment you accept them.

1. Who you are contracting with

The service is operated by AiTrader.com Pty Ltd (ABN 69 673 396 097), a company incorporated in Australia and based in Sydney, New South Wales, Australia. In these terms “we”, “us” and “TrueBuy” mean that company, and “you” means the person using the service.

You can reach us at hello@truebuy.ai. That is the address for notices under these terms.

2. What the service is

TrueBuy is an information service for people buying residential property in Australia. It does four things:

  • It estimates what a property may be worth from publicly available sales data.
  • It reads documents you upload - a contract of sale, a strata report, a building and pest inspection, certificates and searches - and reports things in them that may cost you money or move risk onto you, quoting the document and citing the page.
  • It drafts messages and letters for you to review, edit and send yourself.
  • It lets you share a report you have paid for with people you choose.

3. What the service is not

This matters more than anything else on this page, so it is stated plainly.

  • It is not legal advice. We are not your lawyer, solicitor or licensed conveyancer, and using TrueBuy does not create a solicitor-client relationship. Every report says so. You must have a qualified conveyancer or solicitor review the contract before you sign anything.
  • It is not financial or investment advice. Nothing here takes your circumstances, objectives or needs into account, and none of it is a recommendation to buy, not to buy, or to pay a particular price.
  • It is not a valuation. Our price estimates are not, and must not be treated as, a valuation by a certified practising valuer. They cannot be used for lending, tax, family law, insurance, probate or any other purpose that requires a formal valuation.
  • It is not a real estate agency service. We do not act as your agent, we do not negotiate on your behalf, and we never contact a vendor, an agent or a solicitor for you. Every message the service drafts is sent by you, under your name, after you have read it.
  • It is not a building, pest or strata inspection. We read the reports you give us. We do not attend the property or inspect anything.

4. How price estimates are produced, and their limits

Our estimate is generated by an automated model. It is not a human opinion and no person reviews it before you see it. In outline it works like this:

  • We identify the property from the address or listing link you give us.
  • We collect recently disclosed sale prices for comparable properties nearby and in the same suburb from publicly accessible sources.
  • We discard outliers, weight the remaining sales by how similar they are to the subject property and how recent they are, adjust for observable differences such as property type and bedroom count, and where the data supports it, for movement in local prices over time.
  • We produce a likely range rather than a single number, and a confidence figure that reflects how many usable comparable sales we found.
  • Where the source we can reach publishes its own automated estimate, we show it beside ours as a second opinion. We do not merge it into our number.

The limits follow from the method. We can only use sales that have been disclosed publicly; in some suburbs most are withheld. We cannot see inside the property, its condition, its outlook, its renovations or anything else that is not in the data. Automated estimates are least reliable for unusual properties, in thin markets, and when prices are moving quickly.

You must not rely on our estimate as the basis of an offer. It is a starting point for your own research. Before you commit money, get advice from a licensed valuer or a real estate professional who has seen the property.

If you believe an estimate is wrong, you can tell us. Claim the property from its estimate page and request a review, and you can also request a formal appraisal. We describe both in section 5.

5. Reviewing an estimate, and appraisals

Anyone can ask us to review an estimate. If you are the owner or the agent for a property you can claim it, which tells us who is asking and lets us record what you say is wrong. We will look at the data behind the estimate, correct anything factually wrong about the property, and either re-run it or tell you why we have not.

A request for a review is not a promise to change a number, and asking for a review does not entitle you to a particular result. Where a property genuinely cannot be estimated reliably we will say so and remove the number rather than replace it with a better-sounding one.

A formal appraisal is a separate service performed by a qualified third party, arranged through us at a price quoted to you before it starts. We are not the appraiser and we do not control the appraiser’s opinion.

6. Your account

You need an account to upload documents, buy a report, read a shared report or use support. You must give accurate details, keep your login secure, and tell us promptly if you think someone else has access to it. You are responsible for what happens under your account.

You must be at least 18 and using the service for your own purchase or for a purchase you are authorised to act on. We may suspend or close an account that is being used in breach of these terms, and we will tell you why.

7. Documents you upload

You keep ownership of everything you upload. You give us the right to store and process it for the purpose of providing the service to you, and for nothing else.

You promise you are entitled to upload what you upload. Do not upload anything you do not have the right to give us, and do not upload other people’s personal information beyond what is ordinarily contained in a property document.

  • Your documents are stored in a private bucket and are not public, indexed or shared with other users.
  • You can delete any document at any time, and deletion is real: the file is removed from storage, not hidden.
  • We do not use your documents to train AI models, and our AI providers are engaged on terms that do not permit them to either.
  • Our staff access your documents only where it is necessary to support you or to check that a finding is accurate.

8. Price, payment and refunds

The price of a report is shown before you pay and is charged once per property. It is not a subscription. Prices include GST where GST applies. Payments are processed by Stripe; we do not receive or store your card details.

The first finding on a property is provided free so you can see what the service actually produces before paying. The rest of the review, the numbers and the plan require payment.

Because a report is delivered immediately and cannot be returned, we do not offer change-of-mind refunds. We will refund you if the service fails to produce a report, if it is materially defective, or where a refund is required by the Australian Consumer Law. Ask at hello@truebuy.ai and we will deal with it promptly and in good faith.

9. Sharing a report

You may share a report you have paid for. The person you share it with must sign in to read it, sees the findings and the numbers, and never receives your documents. You can revoke the link at any time.

When you ask us to email a report on your behalf, the message is yours: you write it, it goes out under your name, and replies come back to you. You are responsible for what you send and for having the recipient’s consent to email them.

10. Acceptable use

  • Do not use the service to break the law, to infringe anyone's rights, or to harass anyone.
  • Do not scrape, resell, or systematically extract the service or its outputs.
  • Do not present our outputs as a valuation, as legal advice, or as the work of a licensed professional.
  • Do not attempt to circumvent the paywall, access another user's data, or interfere with the service.
  • Do not upload malware or anything designed to damage the service.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under that law, including that they will be provided with due care and skill.

Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied.

12. Liability

Subject to section 11, and to the extent permitted by law:

  • We are not liable for any decision you make about a property, including any offer you make, any price you pay, any purchase you complete, and any purchase you decide against.
  • We are not liable for loss arising from an error or omission in an automated estimate, or from anything a document review did not find.
  • We are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss arising because a property was bought or not bought.
  • Our total liability to you for all claims connected with the service is limited to the amount you have paid us in the twelve months before the claim arose.

You acknowledge that a document review is an automated reading of the documents you provide, that it may be incomplete or wrong, and that it is not a substitute for a conveyancer, a solicitor, a valuer or an inspector.

13. Third parties

The service relies on third parties, including payment processing, AI providers, mapping and address services, email delivery and hosting. We choose them carefully but we do not control them, and we are not liable for their failures beyond what the law requires.

Data about comparable sales comes from publicly accessible sources. We do not warrant that it is complete, current or accurate.

14. Intellectual property

The service, its software, its checklists and its written content are ours. Your report and the documents you uploaded are yours: you may use them for your own purchase, including giving them to your conveyancer, your lender or your family. You may not resell them or use them to build a competing service.

15. Support

Support is available to signed-in users through the chat in the app and at hello@truebuy.ai. Some answers are given by an automated assistant, which is labelled as such. It answers questions about how the service works and will not give legal, financial or valuation advice; if you need a person, ask and we will pass it to one.

We keep a record of support conversations so we can answer you properly and improve the service.

16. Changes, suspension and ending

We may change these terms. If a change materially affects you we will give reasonable notice, and the version that applies to a report is the one in force when you paid for it. We may change or withdraw features, and we may suspend the service for maintenance.

You may close your account at any time. Reports you have paid for remain available to you unless you delete them.

17. Governing law

These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and the courts able to hear appeals from them.

18. Complaints

If something has gone wrong, write to hello@truebuy.ai with what happened and what you would like done. We will acknowledge within five business days and aim to resolve it within thirty. If you are not satisfied you may take the matter to the ACCC, your state fair trading office, or the Office of the Australian Information Commissioner for a privacy matter.
